GENERAL:

1. If you place an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and the distance sales contract presented to you.

2. Buyers are subject to the provisions of the Law No. 6502 on the Protection of the Consumer and the Regulation on Distance Contracts (OG: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the product they purchased.

3. Shipping fees, which are the product shipment costs, will be paid by the buyers.

4. Each purchased product is delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the 30-day legal period. If the product is not delivered within this period, Buyers may terminate the contract.

5. The purchased product must be delivered complete and in accordance with the qualifications specified in the order, along with documents such as a warranty certificate and user manual, if any.

6. If the sale of the purchased product becomes impossible, the seller must notify the buyer of this situation in writing within 3 days from learning of it. The total price must also be returned to the Buyer within 14 days.

IF THE PURCHASED PRODUCT PRICE IS NOT PAID:

7. If the Buyer does not pay the price of the purchased product or cancels it in the bank records, the Seller’s obligation to deliver the product ends.

PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:

8. After the product is delivered, if it is determined that the credit card with which the buyer made the payment was unfairly used by unauthorized persons and the price of the sold product is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product subject to the contract to the SELLER within 3 days, with the shipping costs belonging to the SELLER.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEABLE REASONS:

9. If force majeure events that the Seller cannot foresee occur and the product cannot be delivered on time, the situation is notified to the Buyer. The Buyer may request the cancellation of the order, replacement of the product with a similar one, or postponement of the delivery until the obstacle is removed. If the buyer cancels the order; if they made the payment in cash, this fee is paid to them in cash within 14 days from the cancellation. If the buyer made the payment by credit card and cancels it, the product price is returned to the bank within 14 days from this cancellation, but it is possible that the bank will transfer it to the buyer’s account within 2-3 weeks.

BUYER’S OBLIGATION TO CHECK THE PRODUCT:

10. The buyer will inspect the goods/services subject to the contract before receiving them; they will not receive crushed, broken, torn packaging, etc., damaged and defective goods/services from the cargo company. The received goods/services shall be deemed to be undamaged and intact. The BUYER must carefully protect the goods/services after delivery. If the right of withdrawal is to be used, the goods/services should not be used. The Invoice must also be returned along with the product.

RIGHT OF WITHDRAWAL:

11. The BUYER; may use the right to withdraw from the contract by rejecting the goods without assuming any legal or criminal liability and without giving any reason within 14 (fourteen) days from the date of delivery of the purchased product to themselves or the person/organization at the address indicated, provided that they notify the SELLER via the contact information below.

DURATION OF THE RIGHT OF WITHDRAWAL:

13. If the purchase made by the Buyer is a service, this 14-day period starts from the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where the performance of the service has started with the approval of the consumer before the right of withdrawal period expires.

14. The expenses arising from the use of the right of withdrawal belong to the SELLER.

15. In order to exercise the right of withdrawal, it is required to notify the SELLER in writing by registered mail, fax, or email within 14 (fourteen) days, and the product must not be used within the framework of the provisions of “Products for which the Right of Withdrawal Cannot be Exercised” regulated in this contract.

USE OF THE RIGHT OF WITHDRAWAL:

16. The invoice of the product delivered to the 3rd party or the BUYER, (If the invoice of the product desired to be returned is corporate, it must be sent together with the return invoice issued by the institution when returning it. Order returns whose invoices are issued on behalf of institutions will not be completed unless a RETURN INVOICE is issued.)

17. The return form, box, packaging, and standard accessories, if any, of the products to be returned must be delivered complete and undamaged.

RETURN CONDITIONS:

18. The SELLER is obliged to return the total price and the documents putting the BUYER under debt to the BUYER within 10 days at the latest from the receipt of the withdrawal notification and to take the goods back within 20 days.

19. If there is a decrease in the value of the goods or the return becomes impossible due to a reason originating from the BUYER’s fault, the BUYER is obliged to compensate the SELLER’s damages at the rate of their fault. However, the BUYER is not responsible for changes and deteriorations that occur due to the proper use of the goods or products within the right of withdrawal period.

20. If the campaign limit amount organized by the SELLER is fallen below due to the exercise of the right of withdrawal, the discount amount benefited within the scope of the campaign is canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

21. Goods prepared in line with the BUYER’s wishes or expressly for their personal needs and which are not suitable for return, underwear bottom pieces, swimwear and bikini bottoms, make-up materials, disposable products, goods that are in danger of spoiling quickly or likely to pass their expiration date, products that are not suitable for return in terms of health and hygiene if their packaging is opened by the BUYER after delivery, products mixed with other products after delivery and cannot be separated by their nature, goods relating to periodicals such as newspapers and magazines other than those provided under a subscription agreement, services performed instantly in an electronic environment or intangible goods delivered instantly to the consumer, and audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables cannot be returned per the Regulation if their packaging has been opened by the BUYER. Furthermore, it is not possible to exercise the right of withdrawal for services whose performance has begun with the approval of the consumer before the expiration of the withdrawal period, according to the Regulation.

22. Cosmetics and personal care products, underwear products, swimwear, bikinis, books, reproducible software and programs, DVDs, VCDs, CDs and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) must be unopened, untried, intact, and unused in order to be returned.

STATE OF DEFAULT AND LEGAL CONSEQUENCES

23. If the BUYER defaults in cases where they make payment transactions by credit card, they accept, declare, and undertake that they will pay interest and be liable to the bank within the framework of the credit card agreement between them and the cardholder bank. In this case, the relevant bank may take legal action; may demand the arising expenses and attorney’s fees from the BUYER, and in any condition, if the BUYER defaults due to their debt, the BUYER agrees to pay the loss and damage suffered by the SELLER due to the delayed performance of the debt.
